CYBERPEDOPHILIA UNDER THE LEGAL-LEGISLATIVE APPROACH OF THE STATUTE OF THE CHILD AND ADOLESCENT

This scientific article has the important and necessary mission of exposing a delicate but realistic topic in the Brazilian scenario, which is related to pedophilia practiced in a virtual environment, that is, cyberpedophilia. This analysis will start from an aspect focused on the Child and Adolescent Statute, current legislation that is more specific to the specific case. Thus, this research starts from the question of how the Brazilian legal system, mainly regarding the legislation regarding the protection of children and adolescents, faces this social problem that can have negative effects on the lives of those who are starting to live in a network. To achieve a possible answer, the objective is, generally, to analyze Cyberpedophilia as a criminal conduct that offends the precepts of the internet and social networks themselves. More specifically, the scientific article in question will deal with the historical evolution regarding the (in)existence of protection in the legal system in the face of cyberpedophilia, as well as the existing criminal types that advocate criminal conduct. Furthermore, more strictly, the research will address the relevant role that civil society and the State can play in the effective fight against cyberpedophilia, including through public policies. To achieve a deeper study, the research methodology used concerns bibliographical research, of a documentary nature, analyzing the scientific framework specific to the topic addressed, as well as opting for deductive work, as it starts from general premises to draw more specific conclusions. Finally, a qualitative research method is used, as it seeks to analyze information with already processed data, in order to contribute to the worthwhile discussion of the central theme, which is Cyberpedophilia under the focus of the Child and Adolescent Statute.
