EFFECT OF TEMPORARY LEAVING ON SOCIETY: RESOCIALIZATION OR PUBLIC INSECURITY?

This article sought to analyze the benefit of temporary release and identify whether its practical results have pointed to an effective process of resocialization of prisoners or, conversely, to the promotion of public insecurity in Brazil. To this end, the methodology adopted consisted of a systematic review of the literature, focusing on articles and studies that address the main thematic axes of this work – that is, public security, resocialization and temporary exit (according to the LEP); and in an inductive analysis method, which made it possible to make final considerations regarding the dilemma of temporary exit between resocialization and public (in)security proposed in the theme, the general objective of this work. Thus, among the results found, it was found that, due to the problems of prison overcrowding and the consequent deficiencies in the measures of the resocialization process, there are recurrent cases of escape and the commission of new crimes by inmates benefiting from temporary release; this evidence generates impunity, perpetuates crime and encourages the population's feeling of insecurity. Finally, the need to reformulate the institute was suggested, referencing New Law 14,843/24, with the aim of remedying the deficiencies that now distort such an important measure.
