OBSTETRIC VIOLENCE AND WOMAN'S RIGHTS AS A PREGNANT AND PARTURIENT

The on-site academic research project focuses on obstetric violence and women's rights as pregnant and parturient women. These illicit acts can be presented as physical, verbal or psychological violence that often ends up leaving consequences for the victims and turning one of the most important moments in a woman's life into a traumatic moment. Given this reality, the general objective to be discussed is obstetric violence and the rights guaranteed to women during pregnancy and parturient. The methodology used will be through existing research in Brazilian literature, making a current study from the period of the Covid-19 pandemic to the present day. Legislation and constitutional principles will be used as a normative source of law, in addition to official documents and basic projects to ensure rights and reduce the rate of obstetric violence. It is important to highlight that the State of Bahia does not have specific legislation classifying obstetric violence as a crime. As a result, a possible solution will be presented to reduce the rate of occurrences in maternity wards and health centers that welcome these women in situations of hypervulnerability during the gestational period, as well as during the postpartum period, even before they become victims. It is expected that the study on the topic will serve as a basis for new discussions and possible bills that may suggest obstetric violence to be listed in the Brazilian Penal and Criminal Procedure code.
