This study addresses state intervention in family decisions, focusing on the mandatory separation of assets for those over 70 years of age. The general objective is to analyze the constitutionality and social implications of this measure. We investigate current jurisprudence, evaluate arguments for and against imposition and propose solutions to the dilemma. We highlight constitutional principles such as human dignity and family solidarity. Using a qualitative bibliographic research methodology, we seek to articulate different perspectives on the topic, providing a comprehensive and critical view. This study aims to contribute to the legal and social debate, providing support for future legislative and judicial decisions
