The payment of the fine penalty as a requirement for parole is a demand that the judge of penal execution may determine to be fulfilled by the convicted individual who has had a fine imposed in the sentence. However, in many cases, the convict does not even have the means to bear the payment of this fine, either due to lack of job opportunities during the execution of the sentence as a consequence of the criminal record that remains in the convict's file, in addition to society's prejudice against this class, which often depends on informal work to guarantee their subsistence. In view of this reality, the study sought to delve into the understanding adopted by the Court of Justice of Rondônia in its judgments of Appeals in Penal Execution, aiming to ensure dignity to the convicted individual who meets the requirements of parole. If it is proven that the convict is unable to afford the fine payment, the benefit may be granted, respecting the consolidated understanding of the Federal Supreme Court.
