Abstract

This paper is a bibliographical review, through research in books, articles and case law, mainly from higher courts, which seeks to understand and explain how succumbing fees will be charged in Labor Law due to the lawyers of the succumbing parties in the case of beneficiaries of Free Justice after the changes in Labor Legislation and the understandings of the Ministers of the Superior Labor Court and the Federal Court of Justice, a relevant issue as it involves both the Lawyer's Right to have his work paid for the survival of his family and the User's Right to Free Justice access to justice.
