DATING CONTRACT IN LIQUID COMPANY: A NECESSARY DEBATE IN THE LIGHT OF FAMILY LAW

In contemporary times, marked by the fluidity of relationships and the constant transformation of family arrangements, the debate on the viability and relevance of the dating contract emerges. This article proposes a reflection on the subject in light of Family Law, investigating its relevance and applicability in the liquid society. The aim is to analyze the legal and social foundations that support the use of the dating contract as an instrument for delimiting rights and duties between couples, especially in the face of the growing diversity of forms of affective coexistence. The methodology adopted consists of a bibliographic review and jurisprudential analysis, with emphasis on the constitutional principles of human dignity and private autonomy. The results point to the need for recognition and regulation of the dating contract as a legal tool capable of meeting the demands of contemporary love relationships, offering legal security and respect for individual autonomy. It is concluded that, in the face of the fluidity of relationships in the liquid society, the dating contract emerges as a promising alternative for the adaptation of Family Law to new affective challenges and realities, contributing to the protection of the rights and interests of those involved.
