PSICOLOGIA JURÍDICA: ATUAÇÃO NO DIREITO PENAL EM CASOS DE PSICOPATIA NO BRASIL

Abstract

The main theme of this article is Legal Psychology: Action in Criminal Law in Cases of Psychopathy in Brazil, in which the problem is: How can we think of effective intervention strategies for treatment and reintegration, guaranteeing the safety of society and minimizing of the risks of recidivism? Analyzing this context, the present study was aimed at this general objective, which will analyze the role of legal psychology in Brazil, within the scope of criminal law, specifically in cases involving individuals with antisocial personality disorder, popularly known as psychopathy. To achieve this objective, however, the following specific objectives were established: analyze the relationship between antisocial disorder and the management of the criminal justice system by investigating the characteristics and manifestations of psychopathy that influence the determination of the sentence and contextualize the importance of assessment psychological in the process of judging individuals with psychopathy. The article in question uses bibliographic research as a methodology, through which books, scientific articles, theses, dissertations, magazines and national reports related to the respective topic were analyzed. This bibliographical analysis allowed a more in-depth understanding of the practical consequences of psychopathy in the legal system. Research identified that there are challenges in the performance of legal psychology in Brazil, such as the lack of professional training and preparation of those working in the area, as well as shortages. It is concluded that the role of legal psychology in criminal law in cases of psychopathy is extremely important for justice and society as a whole and that it is necessary to invest in the training of professionals and resources in order to guarantee effective action. effective and quality.
