This article investigated the living conditions between incarcerated women and their children in Brazil, focusing on the fundamental right of children to family life in the closed regime. The central problem addressed was how to guarantee this right given the structural and psychosocial gaps in the Brazilian prison system. The research adopted a bibliographic review and documentary analysis methodology to explore the legal, social and psychological implications of this coexistence in often precarious conditions. The general objective was to investigate the living conditions in the closed regime for children of incarcerated mothers, emphasizing the improvement of infrastructure and psychological support to strengthen family ties and promote healthy child development. The specific objectives included the analysis of institutional policies and practices that influence the maintenance of the mother-child bond, the evaluation of judicial and normative decisions that impact the right to family life, the proposal of adaptations in prison practices based on national and international models successful, and discussion of the psychological and developmental implications for children. The research concluded that there is an urgent need for reforms in prison practices and legislation, so that more humane policies can be developed that meet the specific needs of incarcerated women and their children, helping to avoid the perpetuation of cycles of social disadvantage and violence.
