CORRUPTION IN POLITICS AND LENIENCE OF THE JUDICIAL POWER: AN ANALYSIS OF THE EFFECTIVENESS OF LAW IN COMBAT CORRUPTION IN BRAZIL

The present scientific work goes through the challenging mission of dealing with the analysis of the realistic phenomenon of corruption in Brazil in the most impartial way, but well positioned in relation to legal aspects, correlating its political persistence with the lack of effectiveness in its combat, especially with regard to the Federal Supreme Court, which must maintain maximum protection for constitutional purposes. In this area, the research in question was guided by the questioning of how it would be possible to relate such ineffectiveness of the Judiciary with the constant persistence of corruption in Brazil. Thus, in order to answer this guiding question, the study was based on a documentary and bibliographic perspective, since it was based on content produced specifically on the subject in vogue, as well as demonstrating itself as deductive, starting from more general premises until reaching more specific conclusions. The work was structured, at first, seeking to understand the roots of corruption in Brazil, starting from its discovery that occurred through colonization by exploitation. On another level, the existing instruments, whether judicial or legal, for the prevention and repression of corruption were analysed. Finally, in order to elucidate the role of the STF, its important, but sometimes questionable, role in the effective fight against corruptive practices that distort the public interest in the country was envisioned.
