Abstract

Social security is understood as a benefit of a contributory nature that makes up social security, which offers social security benefits, the purpose of which is to provide subsistence to the worker in adverse situations, such as death. In this case, there is the death pension, which is considered the amount paid monthly to the insured's dependents. Therefore, the present work questions what requirements are met by the dependents of the RGPS special insured when granting the death pension benefit. With this, the objective is to analyze the circumstances that imply the effective access of the special taxpayer's dependents to the death pension benefit in relation to the minimum requirements required by Law no. ° 8,213/91 and amended by Constitutional Amendment nº 103/2019. The method used in the research was bibliographic through research in scientific articles, theses, monographs, legislation and jurisprudence, with a deductive approach method that allowed information to be sought about the problem, obtaining the expected results regarding the immeasurable damages that the rejection of the benefit causes the family due to insufficient documentation proving the deceased's insured status.
