REVERSE AFFECTIVE ABANDONMENT: ANALYSIS OF THE POSSIBILITY OF DISINSERVATION

Abstract

Today's society must respond to the challenges posed by the aging of the population, regulating laws, modifying norms, reinterpreting existing ones and promoting instruments that improve the living conditions of the elderly. With this interest in mind, it is analyzed whether emotional abandonment can be considered a cause of disinheritance, allowing the testator to sanction his descendants for this reason. Taking the above into consideration, the work focuses on the need to question whether emotional abandonment by children towards their parents can be considered mistreatment and, therefore, making them unworthy of the inheritance? This fact would justify disinheritance. The general objective of this work is to analyze the hypothesis of the possibility of loss of inheritance by children in the case of reverse emotional abandonment. As well as specific objectives of developing a study on the role of parents in the development of their children and the duty of care children have towards their parents; highlight the differentiation in approaches to the concepts of affective abandonment and reverse affective abandonment, and analyze the possibility of disinheritance justified by reverse affective abandonment. To prepare the work, bibliographical research was used, which is responsible for collecting information from readings of official documents, magazines, books, articles, among other sources necessary for the study.
