The present study aims to present the problems related to the use of photographic recognition in the criminal process, which aims to point out a certain individual as a “suspect” of some crime committed, the study seeks to analyze how systemic racism influences convictions founded by use of photographic recognition, since studies show a high incidence of black people being named as victims of this recognition. The designation of the theme consists of verifying how systemic racism, together with photographic recognition, made possible the mass incarceration of mostly black people, who were deprived of their freedom and due legal process. The study goes further, presenting the concept of systemic racism established in Brazil since its colonization and addressing cases of people who were victims of this recognition.
