This work aims to explore animal law as a new and fundamental branch of law. Thus, its objective is to analyze the legal guarantee of animals in light of their right to exist. Protect not only the environment, but also fundamental rights such as life and respect, preventing acts of violence, cruelty and mistreatment. Cruel practices against animals, although constitutionally prohibited, continue to exist and no statistical data demonstrates that their numbers have decreased since the promulgation of the Federal Constitution in 1988. On the contrary, it is clear that violence and oppression against animals have only increased in the years . Animals constitute the most vulnerable population to institutionalized violence. For this, bibliographical research was used as a methodology, and analysis of laws, doctrines and jurisprudence applied to the topic, approaching the results obtained with the research in a qualitative way. With this, it was concluded that there is a need to improve the laws that protect animals as well as sanctions for such acts that are more compatible with their severity, as even though there are laws and regulations that protect them, these beings are still at the mercy of selfishness. and human evil, without having the resources to defend themselves and demand a life with more respect and dignity.
