Abstract

Brazilian Law has made use of technological tools in order to improve the legal and procedural provision of its cases. Furthermore, there is also the use of technology in the scope of the work of legal operators, among which digital evidence stands out. A digital evidence refers to any type of evidence or information that exists in electronic or digital format. Given this scenario, the present study aimed to discuss the impact that digital evidence has on the labor area. With this theme, we sought to analyze more broadly what were the positive changes (or not) that impacted legal operators with the use of digital evidence in labor processes in Brazil. In methodology, it was a bibliographical review, based on selected scientific studies and jurisprudence, whose time frame was between 2018 and 2023 found in databases such as Scielo and Google Scholar. In the results, the use of digital evidence in the Labor Process brings many positive points, in particular, because it is concrete and powerful evidence, based on technical and material elements that are more reliable than testimonial evidence. It also presents greater proximity to the real truth in the specific case, which makes the result of the process fairer for both parties.
