LAW 14.245/2021: AN ANALYSIS OF THE LIMITATIONS IMPOSED ON THE PRINCIPLES OF CONTRADICTORY AND BROAD DEFENSE

Abstract

This article aims to analyze the implications of Law 14.245/2021 on the Brazilian legal system, regarding the changes brought about that caused significant limitations to the principles of contradictory and broad defense. To achieve the objetive described above, the bibliographic and documentary research methology was chosen, involving a detailed analysis of Law 14.245/2021, in addition to a critical review of the legal literature related to the principles of contradictory and broad defense. The main focus used was to higlhlight the changes introduced by the new legislation and evaluate the potential impact caused to the rigths of the accused, considering that the principles of adversarial and broad defense are fundamental to justice and equity in the Brazilian legal system, being A careful analysis is necessary even befory any change that involves them, thus guaranteeing the protection of individual rigths and due legal process. Furthermore, this articlce contributes to the academic and legal discussion on the evolution of the Brazilian legal system, offering a critical analysis of the changes introduced by the new legislation and their possible implications.
