THE APPLICATION OF LAW 14,188/2021 AND THE GRANTING OF PROTECTIVE MEASURE TO TRANSSEXUALS IN THE DOMESTIC AND FAMILY SCOPE IN THE FACE OF PSYCHOLOGICAL VIOLENCE

Abstract

The hypothesis to be developed is psychological violence against women, provided for in Article 7, II, of the Maria da Penha Law, ended up being added to Article 147 – B, of the Brazilian Penal Code, as amended by Law 14,188/2021 .
Furthermore, art. 12-C, allowing the aggressor to be removed in the event of physical or psychological violence. In such a way, it will be analyzed whether this type of psychological violence against women (domestic and family) would also apply to transsexuals, for the purposes of granting a protective measure.
