SHARED CUSTODY AS A MEANS OF PREVENTION PARENTAL ALIENATION

This Course Completion Work is dedicated to analyzing shared custody as an effective instrument to prevent parental alienation. For that, the deductive method is used, through bibliographical research. Initially, the constitutional principles that guide Family Law are analyzed, addressing its main characteristics. Next, the material and procedural aspects of parental alienation are studied, presenting the concept of parental alienation, the distinction between parental alienation and parental alienation syndrome, the effects of these behaviors on children or adolescents, the implantation of false memories and a brief analysis of Law n. 12,318 of August 26, 2010. Thus, the importance of adopting shared custody was verified, even without parental consent, as it is the most appropriate measure to prevent the practice of alienating behavior, included in the context of the dissolution of marriage.
