The present article aims to examine the attachability or unteachability of a family property under construction in the process of labor execution, where the employee seeks to satisfy their labor credit from the employer's assets. The objective is to comprehend the extent to which the pursuit of labor credit satisfaction intersects with the right to housing, as guaranteed by the theory of allocation. It is demonstrated that the family property is intrinsically linked to the right to housing and the theory of minimum assets enshrined in Brazilian law, resulting in the immovable property being deemed unattachable in the context of labor credit. The scientific method employed entails qualitative analysis through bibliographic and documentary research. The discussion stems from the applied theoretical perspective on the family property under construction and the examination of this category within the labor process.
