PRISON OVERCROWDING IN AMAZONAS: AN ANALYSIS OF THE STATE OF CALAMITY IN THE PRISON SYSTEM AND ITS LEGAL AND SOCIAL IMPLICATIONS

Abstract

This article analyzes prison overcrowding in the state of Amazonas in light of the recognition of the Unconstitutional State of Affairs by the Federal Supreme Court in ADPF 347/DF. The objective is to examine the main structural and legal factors contributing to the prison system crisis, highlighting the high number of pretrial detainees, judicial delays, and the precarious conditions of prison units. The study shows that this scenario results in serious violations of prisoners' fundamental rights, especially human dignity, and undermines the effectiveness of the Penal Execution Law. Furthermore, it demonstrates that the lack of effective public policies and resocialization programs contributes to increased recidivism and the perpetuation of violence. Finally, the study points to the need for alternative measures to incarceration and public policies aimed at reducing the prison population as a way to address the structural crisis of the prison system in Amazonas.
