This article analyzes the civil liability of the State regarding omissions in environmental oversight, focusing on the environmental, sanitary, and humanitarian crisis in the Yanomami Indigenous Territory, which reached its peak in 2023 receiving widespread media coverage. The analysis aims to comprehend the prevailing understanding regarding State liability for environmental damages resulting from such omissions, based on legislation, legal doctrine, and the current jurisprudence of the Superior Court of Justice (STJ).
