PROBLEMS ABOUT CIVIL LIABILITY FOR THE COST OF THERAPEUTIC ASSISTANT IN SCHOOL ENVIRONMENTS FOR PEOPLE WITH ASD FROM THE PERSPECTIVE OF RECENT COURT DECISIONS

Abstract

Individuals with Autism Spectrum Disorder (ASD) have constitutional and infraconstitutional rights inherent to their neuroatypical condition. Even with a vast standardization on the subject, there is still a great need for legal demands in order to see these rights realized. This article analyzes the main aspects of the civil liability of Health Plan Operators regarding the obligation to pay for therapeutic interventions prescribed for individuals with ASD, more specifically in relation to the provision of Therapeutic Assistants in the school environment, highlighting significant judicial decisions that shape the current panorama.
