PUBLIC ORDER AS A REQUIREMENT FOR THE APPROVAL OF A FOREIGN JUDGMENT AND THE CASE LAW OF THE STJ IN FAMILY LAW

Abstract

Globalization has undeniably changed the paths of law. Thus, there is an increasing need for interaction between the most diverse legal systems, and between people from different states, thus strengthening institutions such as international legal cooperation and the homologation of foreign judgments. In the Brazilian legal system, the STJ is the court responsible for homologating such judgments – many of which deal with family law. Among the legal requirements for this to occur is that of public order. It is therefore necessary to study how the case law of this court has been deciding on such a condition.
