LEGAL REGULATION OF REMOTE WORK: TRENDS AND CHALLENGES FOR COMPANIES

The growing adoption of remote work, accelerated by the COVID-19 pandemic, has profoundly transformed labor dynamics and employee relationships. This Final Course Work (TCC) aims to investigate the legal and business implications of remote work regulations in Brazil, highlighting the experts involved and the approaches applied by companies and authorities to their implementation. To this end, the study will map Brazilian legal provisions, analyze how these regulations impact company operations and labor interactions, and assess the effectiveness of implementation and oversight measures for this practice. Adopting an applied and qualitative approach, the research will be exploratory and descriptive, based on extensive bibliographic and documentary research, including academic works, legislation such as the 2017 Labor Reform (Law No. 13,467/2017) and Provisional Measure No. 1,108/2022, legal opinions, and institutional reports. The critical analysis of these laws will cover aspects such as workday control, the right to disconnect, and occupational health, in addition to exploring their organizational impacts on people management, culture, and employee well-being. The work seeks to fill knowledge gaps, offering a multidisciplinary perspective and supporting the improvement of public policies and business practices, fostering a more equitable and sustainable work environment.
