THE REALITY OF THE BRAZILIAN PRISON SYSTEM AND THE DIGNITY OF THE HUMAN PERSON

Abstract

Brazil's prison system faces critical challenges that directly affect the dignity of the human person. This article analyzes the current situation in Brazilian prisons and how it impacts the fundamental rights of inmates. The research aims to discuss the real situation of the Brazilian prison system and expose its most relevant problems due to the lack of an efficient structure within the prisons. and lack of security. However, it is noted that prisons in Brazil may, in the vast majority of cases, not provide the re-educated person with their recovery, therefore, this study aims precisely to address the guarantees and rights inherent to inmates, which unfortunately are not effective. In this way, the present study plans to analyze the Brazilian penitentiary system, since daily practices in the prison environment and in the application of criminal law sometimes imply a violation of the fundamental rights of inmates. Regarding the assembly of the text, the bibliographic and descriptive method was used, based on doctrines and legislation, in order to have a complete, clear and transparent analysis in light of the proposed theme.
