Abstract

Brazil, currently, has faced several problems regarding the precariousness of the penitentiary system, where there is an increasing number of overcrowded prison units that do not offer structural and maintenance conditions to house the large number of prisoners, a situation that leads to a system increasingly chaotic. In these environments, social reintegration has distanced itself from the expected reality of satisfaction. It is necessary to find solutions that minimize this problem and maximize the objective of deprivation of liberty, that is, the resocialization of the imprisoned person. Therefore, the present study aims to describe what the literature has addressed regarding a possible privatization of the Brazilian penitentiary system, highlighting how privatization could contribute to improving the current scenario. The methodology used was literature review. To survey the publications, some databases were consulted, namely: Scielo and Google Scholar. For the search, the descriptors were used: penitentiary system, privatization, resocialization and Brazilian prisons. Once this was done, 3,330 publications were found, 3,320 were excluded, leaving 20 publications. After analyzing and studying these, it was concluded that it is possible to put into practice the privatization of Brazilian prisons, since this possibility is supported by legislation under some limits. Some Brazilian prison privatization models have already demonstrated that the public-private partnership favors resocialization through the offer of employment, study and professional courses, preparing the prisoner to be reinserted into society.ty.
