ANALYSIS OF THE PROFESSIONAL DRIVER IN THE LIGHT OF THE EMPLOYMENT RELATIONSHIP

The present work addresses the discussion of Law 12.619/2012, which proposes to regulate the working hours of professional drivers, in light of the principles of Labor Law. Thus, this Law has been the subject of deep discussions in the professional and employer segments, with the intervention of the MPT and the help of some government agencies. In view of this, the problem was built around analyzing how Law 12.619/2012 has affected the employment relationship of professional cargo and passenger drivers. Therefore, the objective is to understand Law 12.619/2012 in the light of the principles of Labor Law by making considerations about its implications in the current dynamics of the employment relationship. The method used in the research was bibliographical with an exploratory nature, using theses, monographs and legislation applicable to the subject, with a deductive approach by starting from general premises through a structuralist procedure that allowed to search for information through the elaboration of hypotheses related to the problem. Finally, the expected results about the employment relationship related to professional drivers.
