HATE SPEECH: A VIEW FROM THE PERSPECTIVE OF THE CONSTITUTIONAL GUARANTEE OF FREEDOM OF EXPRESSION ON SOCIAL NETWORKS

The present article seeks to analyze hate speech and the constitutional right of freedom of speech in the context of social networks. To do so, it seeks to understand how far the right and the guarantees that regulate the use and sociability in virtual social media extend, considering the growing number of individuals committing crimes abusing freedom of expression and free expression of thought. In this sense, this study seeks to identify the causes that lead people to adopt such a posture towards other users, and to verify the legal consequences of such actions. To this end, bibliographic research of qualitative approach was conducted, theoretically based on books, theses, monographs, and scientific articles. The conclusion is that social networks are a favorable environment for the exposure of hate speech, but Brazilian laws ensure and protect the rights of individuals, so that it is necessary to use with caution the freedom of expression in the virtual environment.
