THE GUARANTEE OF ACCESS TO THE RIGHT TO HEALTH OF INDIGENOUS COMMUNITIES OF THE BRAZILIAN AMAZON IN TIMES OF THE COVID 19 PANDEMIC

The present work analyzed the fundamental right to health, of the indigenous peoples of the Brazilian Amazon in the context of the COVID-19 pandemic. The research was based on the Brazilian legal system, through the application of fundamental rights, focusing on the right to health of the indigenous people of the Brasilian Amazon in the face of the pandemic context and how the State and government authorities acted in relation to this problem to remedy the obstacles to this, in order to enforce what is foreseen in many normative mechanisms. The research methodology used has a theoretical-analytical character through a conciliation between qualitative methods. Subsequently, a survey of data from statistical research carried out by institutions such as the Articulation of the indigenous Peoples of the Brazil (APIB) and the coordination of the indigenous Organizations of the Brazilian (COIAB) was demonstrated during the most critical periods of the contamination and deaths caused by the COVID-19 among the indigenous population, through this comparative analysis it was noted that there was an underreporting of cases. Finally, it was concluded that despite the measures taken during the period to combat the COVID-19 pandemic, the duty of cooperation between the institutions was insufficient.
