Abstract

In Brazil, the right to health has a constitutional and universal provision. However, the judicial route has been widely used for access to health goods and services. This study aims to discuss the judicialization of access to medicines in Brazil. Considering this problem, there is an increase in the search for the Judiciary in order to obtain the right of access to health services, especially to medicines. The study addresses the principle of comprehensiveness, discussing the judicial control of public policies. The general objective is to analyze the evolution of judicialization for the search for medicines in Brazil. With the specific objectives of clarifying points ignored in the debate on the judicialization of access to medicines, as well as the need to find alternatives to excessive judicialization in matters related to health, especially access to medicines. It is a qualitative descriptive study, adopting the methodology of bibliographic review.
