THE PRECARIOUSNESS OF THE BRAZILIAN PENITENTIARY SYSTEM AS THE MAIN CAUSE OF CRIMINAL RECURRENCE

Abstract

The main theme of this project is the precariousness of the Brazilian penitentiary system as the main cause of criminal recidivism. This precariousness of the Brazilian prison system is linked to the lack of structures and the absence of the State with its inmates, more specifically in the lack of rehabilitation of the prisoner, due to the failure of the State. In this sense, the present research has as general objective to present the main consequences of the precariousness of the Brazilian penitentiary system as the main cause of criminal recidivism. The following specific objectives were defined: to describe the history of the Brazilian prison system, to compare the Brazilian prison reality with other systems and to point out some alternative solutions to improve the Brazilian prison system. Addressing the precariousness of the Brazilian penitentiary system as the main cause of criminal recidivism is justified by its relevance in combating the lack of care on the part of rulers in prisons and with inmates, the prison system has become degrading and humiliating, since the The prison sentence should re-socialize the criminal, but in practice this is not happening. The present study consists of a descriptive research, before that the results will be applied in a qualitative way, from the collection of secondary sources, including bibliographic and documentary review. As a source of research in order to collect a theoretical framework, books, websites, scientific articles, the penal code and national legislation will be used. It is concluded that the precariousness of the Brazilian penitentiary system allows for the high rates of criminal recidivism in Brazil, resulting in a failure in the prisoner's resocialization function due to the conditions in which inmates are subjected during their prison period, but it is also necessary to use of improvements in treatment within prisons to change this problem.
