LEGAL ANALYSIS OF BPC/LOAS REQUIREMENTS FOR SOCIAL ASSISTANCE

The 1988 Constitution establishes Social Assistance as a non-contributory policy, aimed at those whose material, social and cultural needs could not be guaranteed either by income from work, or by the generational condition-childhood and old age-, or by physical and mental needs. . The BPC/LOAS was established on December 7, 1993, as one of the objectives of Social Assistance. The article aims to evaluate the criteria for obtaining the BPC/LOAS, from the point of view of the effectiveness of the social incision. of a maximum of 10 years, but prioritizing those of the last 5 years, thoughts of authors that exceed 10 years were used, but it does not harm the article, as they are texts that are only premises for the central subject. In the context of quick, didactic reading, the discourse text was used, comparison of cases for better reading and reader understanding. For the elaboration of the same, academic articles, books, medical websites, and the Ministry of Health website were used. The language was not a factor of exclusion of the works of the collection, but of aggregation, for a better understanding of the dimension of the subject.
