CHANGES IN THE BENEFIT FOR TEMPORARY DISABILITY AFTER THE PENSION REFORM

Abstract

The present work aims to analyze the changes in temporary disability benefit after social security reform. The whole theme is covered in three chapters, starting with the origin of social security in Brazil and the Federal Constitution of 1988, with a brief analysis focused on temporary disability benefit and its general aspects, it also addresses what are the guiding principles of social security. Leaving soon after for an analysis on social security reform and constitutional menu 103 of 2019 focused on temporary disability benefit, and finally, ponders on law no. 8,213/91 and respectively what were the changes added through the pension reform. The central objective of this work is to examine the Temporary Disability Benefit and all its aspects, appreciating the requirements to obtain the benefit, as well as its peculiarities and changes that come from the reform. In addition, we will discuss the social impacts caused to policyholders who enjoy the benefit for temporary disability. Finally, we believe that this is an important benefit in complicated and difficult periods in the insured person's life, providing the insured with an income guarantee. As much as he is unable to carry out his work activity, he finds in the benefit a form of tranquility so that he can recover and rehabilitate himself to the work environment.
