MARIA DA PENHA LAW AND THE EFFECTIVENESS OF PROTECTIVE MEASURES MARIA DA PENHA

Abstract

The present study aims to analyze the effectiveness of protective measures provided for in the Maria da Penha Law. Identify whether, in fact, the protective measures provided for in Law 11.340/06 are effective against domestic violence and, what are the procedures to provide protection to the victim. Demonstrating the real situation of the Law in favor of women. Another objective of this study is to analyze the aforementioned law and its applicability in society, considering that domestic violence is a social problem. Also addressing the fact that the social class of the woman is independent for her to be a victim of violence. Dealing with this controversial subject of our society is of great appreciation, since many women go through situations of domestic violence, regardless of the environment in which they live. However, domestic violence has always existed, however, it only began to be addressed in a relevant way after Law 11.340/06. In this way, the State's position in relation to the application of protective measures inherent to the fight against domestic violence and the positive and negative points of the same, its real effectiveness and the obstacles that women face in the search for the punishment of the aggressor will be addressed. This will seek studies on the subject through news, magazines, documentaries, bibliographic research with authors such as Machado; Goncalves and Souza; Lucena; Fernanda Moretzohn; Patricia Burin; Maria Montenegro.
