This research aims to analyze the state negligence in relation to the complaints made against child sexual abuse in Brazil, especially in a context of underreporting and intra-family violence, considering that, according to the National Human Rights Ombudsman of the Federal Government, in the year 2021, 6,091 complaints have already been registered, between January 1st and May 12th, which represents 17.5% of approximately 35 thousand cases that add up all types of violence against children and adolescents in the same period. which emphasizes how the theme addresses a necessary and delicate topic. Thus, we sought to analyze the role of the state in relation to victims of child sexual abuse and the neglect of their actions. For this, the deductive method was used, based on qualitative research, based on articles, books and jurisprudence.
