DOMESTIC INTRAFAMILY VIOLENCE AGAINST CHILDREN AND ADOLESCENTS: A LOOK AT THE PERFORMANCE OF PROTECTION NETWORKS IN THE MUNICIPALITY OF ITAPERUNA-RJ

Abstract

The present work seeks to analyze the performance of protection networks in the Municipality of Itaperuna-RJ to ensure the fundamental rights of children and adolescents victims of intrafamily domestic violence. As a specific objective, the historical context of the normative construction of childhood in Brazil was presented, approaching the rights guaranteed in the national legislation and the guiding principles provided for in Law nº 8.069/90 (ECA). In addition, a study is carried out on the concept and the various manifestations of domestic violence against children and adolescents. The analysis of the theme has a social justification because it exposes a discussion about the mechanisms to curb domestic violence against children and adolescents. The methodological alignment of the present work is of a bibliographical and qualitative nature, being used as a basis for the research legal doctrines, seeking an analysis of the applicability of Law nº 8.069/90 (ECA) as a mechanism to guarantee the fundamental rights of children and of adolescents who are victims of a violent intra-family environment. It is concluded that despite all the advances registered in the current legislation, many children and adolescents still experience a violent domestic scenario, being of paramount importance the construction and/or implementation of public policies aimed at the empowerment of the family nucleus.
