DATING AGREEMENT AS A FORM OF EXCLUSION FROM THE STABLE MARRIAGE

Abstract

The present study have as main objective analyse the possible validity of dating contract as way of mischaracterize the stable union, making for this an analyse of the current concept of family, as well as seeking the difference between the institutes of stable union and dating, and for consequence show their different effects, searching legal basis on Civil Contractual Law and Family Law. And the specific objectives: analyse the efficiency of Dating Contract in front of the institute of Stable Union, in order to value the possibility of autonomy of the will prevail over the characterizing elements of Stable Union, stepping away the incidence of law on parts that do not desire to grant patrimonial effects to each other in case of colapse of the love relationship. About the technical proceeding, it is bibliographic, with main basis on 2002 Civil Code and the theoretical contributions of Pablo Stolze (2017), Pamplona Filho (2017), Tartuce (2017) Gonçalves (2013), Venosa (2011) and field research, using as confirmation mechanisms the jurisprudence and questionary with open issues, from the dialectic method and the qualitative approach. The result verified the invalidity of dating contract in legal order.
