MIGRATION POLICY AND LABOR PROTECTION: FOR THE EQUAL TREATMENT OF FOREIGN AND NATIONAL WORKERS

Several reasons throughout human history have made people leave their territories in search of better living conditions in other countries. In Brazil, the history of immigration began in the context of colonization, with the aim of exploring national lands, causing the great flow of forced migration of African slaves, which lasted until the mid-1880s. From the abolition of slavery to the present day , Brazil is the target of considerable migratory currents, and in recent decades this contingent has intensified, mainly because Brazil has become a destination for a large number of immigrants from bordering countries. The present research seeks to present the legal norms that protect the rights of immigrants and demonstrate that despite the existence of a promising legislation of legal equality, many still face situations of exploitation, especially within the labor scenario, as a result of informal insertion in the labor market. . Therefore, the need for an equal treatment whose human rights are duly respected is revealed. The method used was bibliographic research of a qualitative nature and analysis of jurisprudence and current laws that regulate the condition of immigrants in the national territory, in order to better assimilate and interpret the theme. Understanding the changes in scale and emerging trends related to global social and economic transformations, such as migration, is essential for considering a future in which value is attached to the protection of human rights and the dignity of the human person.
