OBSTETRIC VIOLENCE: AN ANALYSIS FROM THE PRISM OF VIOLATION OF FUNDAMENTAL RIGHTS OF WOMEN

This article deals with obstetric violence, seeking to expose the violence faced by women in the prepartum, delivery and postpartum periods, which are the phases in which women are most vulnerable. The term “obstetric violence” was recently coined by Dr. Rogelio Pérez D’ Gregorio, president of the Society of Obstetrics and Gynecology of Venezuela. The objective of this work is to deal with obstetric violence faced by women during the parturition process. Thus, at first, a historical and conceptual exposition was carried out on the subject, in addition to addressing the violent practices present in the area of obstetrics. Then, it was demonstrated that obstetric violence is gender violence and a violation of women's fundamental rights. Finally, it was presented the protection norms existing in the Brazilian legal system, as well as the actions developed by other countries aimed at fighting obstetric violence. The methodology used to deal with the subject was based on qualitative bibliographic research, based on the bibliographic survey of scientific articles. It is concluded that obstetric violence results in real violations of women's fundamental rights and the lack of a specific law for such violence is one of the primary factors for the occurrence of violation of the rights of parturients.
