Abstract

This article aimed to analyze the peculiarities of the North American Institute for Criminal Settlement, called Bargaining, what the characteristics of the American mechanism, and analyzing the possibility of transposition of this into Brazilian procedural law, as proposed in Bill 882/2019 (Anti-Crime Project).Moreover, the article sought to expose the feasibility of implementing this mechanism in Brazilian law, with the protection of the fundamental rights and precepts protected by the Federal Constitution. The research methods addressed were reviews of national and international bibliographies and content analysis, based on deductive and dialectical methods.
