The work presents the review of documents - being laws, declarations, statutes - national and international, aiming to study the converging points and analyze them in the guise of human rights. The Brazilian Constitution of 1988, the Universal Declaration of Human Rights, the Statute of the Child and Adolescent - ECA, the Universal Declaration of the Rights of the Child of 1959 and the Convention on the Rights of the Child of 1989 and the Law of Guidelines and Bases of National Education of 1996. Throughout the text, articles referring to the right to education were analyzed, considering it as a subsidy to guarantee other rights. Emphasis was given to the value that education has beyond the schooling process, considering that education crosses institutional limits, and acts as a mediator in the relationships between subjects, the social environment, culture, citizenship, being co-responsible for the formation personal, professional and citizen, when it is guided, above all, in the principle of equality, without distinction of race, religion and nationality.
