Abstract

This study analyzes the limits and challenges in addressing LGBTphobia in contemporary Brazil, investigating the complex relationships between culture, public security, and criminal justice. The main objective is to understand how formal and informal social control mechanisms influence the processes of exclusion or protection aimed at the LGBTQIAPN+ population. Methodologically, a qualitative and exploratory literature review was adopted, based on the thematic analysis of scientific literature and normative frameworks. Results show that, despite significant legal advances — such as the classification of LGBTphobia as social racism by the Supreme Federal Court in 2019 —, high rates of structural violence and underreporting persist. Theoretical frameworks such as Butler (2003) and Bourdieu (1989) aid in understanding violence as a symbolic and institutionalized phenomenon. The study identifies an urgent need for the standardization of criminal records and police action that effectively guarantees rights. It concludes that addressing violence requires overcoming cultural barriers and improving articulated public policies aimed at promoting citizenship and respect for diversity.
