Abstract

This article aims to analyze the sentencing process for the crime of intentional receiving (Article 180 of the Brazilian Penal Code), evaluating its effectiveness in repressing property crimes. The study is based on a doctrinal review, legislative analysis, and the examination of recent precedents from the Superior Court of Justice and the Supreme Federal Court. It was found that, although the legal system provides adequate mechanisms for punishing the receiver, practical application faces evidentiary and procedural difficulties that reduce the preventive nature of the rule. It concludes that combating intentional receiving requires not only appropriate punishment, but also public policies focused on prevention and the efficiency of criminal prosecution.
