LABOR COMPLIANCE AS A STRATEGIC TOOL FOR MITIGATING EMPLOYER CIVIL LIABILITY IN CASES OF WORK ACCIDENTS

Introduction: Worker safety and health are fundamental pillars of the Brazilian legal system, with the employer being the guarantor of a healthy working environment. However, failure to comply with these obligations often results in occupational accidents, generating civil liability and high judicial liabilities. Aim: This study aims to analyze how the implementation of a Labor Compliance program can act as a strategic tool to mitigate the employer's civil liability, transforming a reactive posture into proactive risk management. Materials and Methods: Qualitative research of an exploratory and descriptive nature was used, based on a bibliographic and documentary survey and analysis of the current regulatory and jurisprudential structure. Results: It was observed that the existence of a robust compliance program, focused on the inspection of PPE, training, and CIPA performance, constitutes proof of diligence capable of mitigating employer fault. Conclusion: It is concluded that Labor Compliance, by systematizing compliance with Regulatory Standards, serves as a mechanism for legal defense and preservation of the physical integrity of workers.
