ARTIFICIAL INTELLIGENCE AND THE DUTY TO PROVIDE JUSTIFICATION: AN ANALYSIS OF ALGORITHMIC TRANSPARENCY IN LIGHT OF DUE PROCESS AND CNJ RESOLUTION 615/2025

This article analyzes the tension between the implementation of artificial intelligence (AI) tools in the Brazilian Judiciary and the constitutional duty to provide reasoning for judicial decisions, as provided for in article 489, § 1º, of the 2015 Civil Procedure Code. The study investigates how screening and automation systems, such as Victor (STF) and Athos (STJ), impact the procedural efficiency paradigm in light of the guarantees of due process of law and CNJ Resolution 615/2025. The methodology consists of bibliographic and documentary research, based on the analysis of legal doctrine. It is concluded that, although AI promotes speed and effective instrumentality, it cannot replace the value judgment and linguistic understanding required by exhaustive reasoning, under penalty of nullity of decisions and restriction of the adversarial principle.
