Abstract

This systematic literature review analyzes the institution of criminal rehabilitation under Articles 93 to 95 of the Brazilian Penal Code, understood as a legal mechanism aimed at ensuring data confidentiality and suspending the collateral consequences of conviction. This research is justified by the need to evaluate the effectiveness of this legal instrument in light of the challenges imposed by the network society. The methodology consisted of a bibliographic survey conducted through the Google Scholar and OasisBR databases, covering the period from 2021 to 2026. This timeframe corresponds to contemporary debates concerning the humanization of the prison system and the implementation of the Plano Pena Justa (Fair Sentencing Plan). The findings highlight the practical limitations of criminal rehabilitation within the digital environment, as well as the scarcity of studies addressing the impact of online judicial databases on the persistence of criminal records. The study concludes that criminal rehabilitation demonstrates reduced effectiveness in the contemporary informational landscape, thereby requiring complementary mechanisms to ensure effective social reintegration.
