LAW 13.123/2015 AND ENVIRONMENTAL EDUCATION: PATHWAYS TO THE SUSTAINABLE USE OF BRAZILIAN GENETIC HERITAGE

Brazil is considered one of the most targeted countries in the world, by companies and researchers, because of its rich biodiversity. With the Convention on Biological Diversity, during Eco-92, the discussions about the need to regulate the access to Brazilian biodiversity and also about the use of these resources had been enlarged. In addition, the protection and the access to associated traditional knowledge, and the share of benefits were discussed as well. All of this was consolidated with the publication and validity of Law 13.123, dated May 20, 2015. Thus, this work aims to investigate the use of Brazilian biodiversity based on Law 13.123/15, on economic, law and science and technology aspects. The research showed that Law 13.123/15 arises with the Amazonian Biodiversity protecting and preserving intention, limiting the access and the use of its genetic patrimony. However, this restriction was not favorable at all, such as national and foreign researchers who, since the validity of Law 13.123/15, have been limited to use and to access the Brazilian Biodiversity.
