Abstract

The scientific article intends to presente the interference of the declaration of unconstitutionality of the right to oblivion in the General Law of Data Protection Persons (LGPD). The study revelead the evolution of data protection history in the national order, ending with the latest legislation on the subject. Also, it was explained the correlation of the right of to be forgotten to fundamental rights presented in the Federal Constitution of 1988.
