CRIMINAL AND PROCEDURAL ASPECTS OF THE ANTI-CRIME PACKAGE IN THE EXECUTION OF SENTENCES: A CRITICAL ANALYSIS OF LEGISLATIVE INNOVATIONS

Abstract

The so-called "Anti-Crime Package," established by Law No. 13.964/2019, was the result of a political and social context marked by popular demand for greater rigor in combating crime and corruption. This law profoundly altered several legal instruments, including the Penal Code, the Code of Criminal Procedure, and the Law on Criminal Execution. Given this reality, this study aimed to critically analyze the penal and procedural aspects introduced by the Anti-Crime Package (Law nº. 13.964/2019) within the scope of sentence execution. It was based on a literature review, drawing on scientific articles, books, periodicals, and current legislation on the subject. Data collection was carried out using databases such as Scielo, Google Scholar, among others, for the period from 2020 to 2025. The results clearly showed that the legislation adopted a predominantly punitive approach, with the tightening of rules for the execution of sentences, the restriction of penal benefits, and the expansion of control mechanisms in the prison system. These changes reflect a political-criminal choice that prioritizes repression and the neutralization of the offender, to the detriment of broader policies of prevention and resocialization. In the field of penal execution, changes in the progression of regimes, parole, and the Differentiated Disciplinary Regime demonstrate a shift in focus from social reintegration to institutional security. Although such measures seek to contain the actions of criminal organizations, their collateral effects on the dignity of the person deprived of liberty and on the resocializing purpose of the sentence cannot be ignored.
