GUARANTEEING THE RIGHT TO HOUSING FOR INDIVIDUALS WITH AUTISM SPECTRUM DISORDER IN THE BRAZILIAN LEGAL FRAMEWORK

This article analyzes the effectiveness of the right to housing for autistic individuals in the Brazilian legal system. The work uses a qualitative methodology based on a bibliographic review and documentary analysis. The research addresses the constitutional foundations of the right to housing, the evolution of social rights in Brazil, and specific regulatory instruments for people with disabilities, including the Brazilian Inclusion Law (Law No. 13,146/2015) and the National Policy for the Protection of the Rights of Persons with ASD (Law No. 12,764/2012). The work identifies that, despite the existence of significant legal frameworks, substantial gaps persist in the practical implementation of the right to housing for autistic individuals. The vulnerabilities intrinsic to ASD are not adequately addressed by existing housing programs. The study concludes that the Brazilian legal system, although it has an important regulatory framework, does not effectively guarantee the right to housing for people with ASD, requiring specific public policies and regulations. The research contributes to the debate on the fundamental rights of people with disabilities and highlights the need to develop inclusive and specialized housing policies.
